Upon graduation from law school, Scott was a Judicial Law Clerk to the Honorable Joel B. Rosenthal (ret.) of the United States Bankruptcy Court for the District of Massachusetts, Central Division for the 2008-2009 term. In 2009, Scott joined the law firm of Gallant & Ervin in Chelmsford where he primarily practiced in the areas of commercial litigation, bankruptcy and creditor’s rights, intellectual property infringement litigation, real estate and business transactions and collections. Scott handled matters before the state and federal courts in Massachusetts and New Hampshire. In 2014, Scott joined Shaevel & Krems.
Obtained dismissal of Complaint filed against client in District of New Jersey Due to Lack of Personal Jurisdiction. (Vanz, LLC v. Mattia & Associates, 2016 WL 3148400 (D.N.J. 2016))
Successfully defended against IT Company's attempt to enjoin former employee from commencing employment with competitor based upon non-compete provision which Court determined was overly broad.
Represented Hindu Temple appealing grant of variance to abutter and obtained summary judgment invalidating variance.
Second seated trial in Federal Court to determine ownership of copyrights and obtained jury verdict that copyrights were validly transferred to client and obtained attorney's fee award under Copyright Act as a prevailing party. (Zamoyski v. Fifty-Six Hope Rd. Music Ltd., Inc., 767 F.Supp.2d 218 (D.Mass. 2011))
Obtained the dismissal of a tenant’s attempt to remove a state court eviction action to the Bankruptcy Court.
Obtained a Bankruptcy Court order that a landlord could apply a Debtor’s security deposit to the landlord’s unsecured claim.
Represented several creditors regarding claims for monies owed for services rendered and obtained attachments, trustee process orders, reach and apply orders, and other equitable relief before the Superior Court to secure the claims.
Obtained confirmation of client’s Chapter 13 plan, which did not require payment of any monies to a former secured creditor.
